This document constitutes an official offer (public offer) by Individual Entrepreneur "ARZU GALLERY" (hereinafter referred to as the "Seller") addressed to an unlimited circle of individuals and legal entities (hereinafter referred to as the "Buyer") to enter into an artwork purchase and sale agreement on the terms specified below, in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan.
1. Terms and Definitions• Offer — this document titled "Public Offer on the Sale of Artworks", published on the Internet at www.arzugallery.com.
• Acceptance — the full and unconditional acceptance of the terms of the Offer by the Buyer by placing an order and completing full payment via the TipTop payment gateway on the Website.
• Seller — IE "ARZU GALLERY" (BIN/IIN 960904451173, legal address: Kazakhstan, Kostanay, Abay Ave. 26/182).
• Website — the internet resource owned by the Seller, located at the domain name www.arzugallery.com.
• Products (Goods) — unique artworks offered for sale on the Website (paintings, original abstract canvases, sculptures created as one-of-a-kind pieces or limited series).
2. Subject of the Agreement2.1. The Seller undertakes to transfer ownership of the Products to the Buyer, and the Buyer undertakes to pay for and accept the Products in accordance with the terms of this Offer.
2.2. All Products displayed on the Website represent fine contemporary art, including unique paintings and sculptural objects.
3. Order Placement and Payment Procedure3.1. The order is placed by the Buyer independently using the standard functionality of the Website www.arzugallery.com.
3.2. Payments for the Products are processed electronically using the integrated TipTop payment system.
3.3. The price of the Products is indicated on the Website. Payment of the order signifies the Buyer's full agreement with the designated price of the item.
4. Terms of International Delivery4.1. Worldwide delivery of the Products is carried out via international courier and logistics services at the Seller’s expense.

5.1. All Products (sculptures, paintings, art objects) presented in the Seller's Catalog are unique works of art, created in a single copy and possessing individually distinct characteristics.
5.2. Pursuant to the Civil Code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "On Protection of Consumer Rights", unique artworks of proper quality are non-refundable and non-exchangeable, as replacing them with an identical item of proper quality is impossible due to the absolute uniqueness of each piece.
5.3. The moment of transfer of ownership rights and risk of accidental loss or damage to the Products passes to the Buyer upon delivery to the Buyer (or their designated Recipient) and signing of the Acceptance Act (or delivery receipt from the courier/logistics company).
5.4. Upon receipt, the Buyer is obliged to conduct a complete inspection of the Products to ensure the absence of visible defects, scratches, chips, deformations, or other damages.
5.5. Signing the Acceptance Act (or courier delivery slip) without reservations confirms that the Products were delivered in proper condition, and the Buyer has no claims regarding quality, appearance, or safety.
5.6. The Seller is not liable and will not accept returns for Products whose defects or damage arose as a result of improper transportation after acceptance, or violation of display and care guidelines (exposure to direct sunlight, high humidity, or mechanical damage).
5.7. In the event of discovering latent manufacturing defects in materials that occurred prior to delivery, the Buyer is entitled to submit a written claim with photo and video evidence. Upon verification of the defect, the Seller undertakes to provide free defect remediation (restoration), proportionally reduce the price, or accept the return of the Product if remediation is impossible.
